Indore: Madhya Pradesh Chief Minister Kamal Nath today (18 October 2019) gave the categorical assurance that his government will ensure accountability and go all out to make Madhya Pradesh an investment -friendly state.

The Chief Minister was speaking at the opening of “Magnificent MP” Investment Summit at Brilliant Convention Centre here in Indore – also called the commercial capital of Madhya Pradesh.

He called upon the captains of industry to participate in the development of the state and help in creating new jobs. He went on to underscore that today’s event is not a platform for signing of MoUs in which deals worth thousands of crores are made and are not converted into ground rality. The Chief Minister said that the goal is to bring in real investment, create employment opportunities so that the state becomes economically strong and every section of the society is able to flourish.

Nath said that in the last ten months we have put in extra efforts and achieved the impossible. The property guidelines have been reformed to boost the real estate sector. Indore-Bhopal metro work has been started. Permit and license fee of colonizers have been reduced from 27 percent to 5 percent.The Chief Minister said that in the field of infrastructure development, Bhopal, Indore Industrial Corridor is being developed. Under it, a satellite city will also be developed. R.R.T.S will be arranged to connect Bhopal and Indore to metro.

The Chief Minister informed that the government will provide additional facilities in the tourism sector in addition to the special facilities to the branded hotels. The Global Skill Park is being set up in the state in collaboration with the ITI Singapore. This will help in boosting skill development. He further announced that Madhya Pradesh would be the first state in the country, where energy storage capacity will be established. As many as 2 lakh solar pumps have been made available in the agriculture sector. Solar power at low rates will be made available to the industries. In the case of land transfer, instead of taking permission, self-assessment is being encouraged. Along with this, the diversion charges are also being rationalised.

The Chief Minister further said that wide range reforms are being undertaken in the procedure of government and administration to create an industry friendly environment.

Congratulating the Chief Minister for the implementation of the pro-investors policy, he said that he has had special attachment with Madhya Pradesh. The jungle, wildlife and ecology of the state is very significant for its economy, he said adding Madhya Pradesh is the only state in the country, where Jio data is used the maximum compared to Korea, Germany and France.

Bhopal: In an exclusive interview to newsroom24x7, Rohit Gupta describes the Metro rail project for Bhopal and Indore as the fruit of a plant that he had sown many years ago when he had come to Bhopal for a presentation to the then chief Minister Babulal Gaur. He had underscored that for better economic developmemt of Madhya Pradesh they needed a world class transportion system for the cities of Bhopal and Indore. To be globally compettive, Rohit had asserted, one must provide a world class transportaion system in the major cities so that people can have a high quality of life and the trend continues so that other states also try to invest and provide such facilities. Thereafter the State government started thinking of a metro, Rohit said and went on to inform that there was some communication but nothing came ouf it immediately. After a few years there was a tender for the preparation of a detailed project report (DPR) for Bhopal and Indore. Rohit’s company applied for it and won the tender in a global competition because of the high level of the tehnical proposal and lowest cost.

Rohit heads Rohit Associates Cities & Rails Pvt.Ltd, the company appointed to prepare the detailed project report for the MRTS including the selection of the system for the city. Based on the multicriteria analysis and recommendations by his company, the Government of Madhya Pradesh had approved the inception report on 30 June 2014. The company also did comprehensive Geotechnical surveys and spearheaded the formation of the company from concept to the its registration for the implementation of the project. The project was scheduled to be completed by 2021 with the first phase in December 2019.

After the DPR was approved by State Cabinet, it was approved by the Central Government in October 2018 and the foundation of its first phase was laid by Madhya Pradesh Chief Minister Kamal Nath in September 2019.

Indore’s MY Hospital turns into a black hole, many patients die due to disruption in oxygen supply

Indore: The MY Hospital in this commercial capital of the central Indian State of Madhya Pradesh turned into a black hole early morning Thursday when a number of patients, who were in a critical condition and were on artificial respiration died gasping for breath when the oxygen supply snapped under mysterious circumstances.

According to available reports 11 persons, including two children, have died at MY hospital in last 24 hours. It has been reported by a section of the media that the hospital administration had drawn an iron curtain to hide the disaster by taking the position that there was no negligence and such deaths were routine in a large hospital. While hospital sources have pointed to disruption of oxygen supply, Indore divisional Commissioner Sanjay Dubey has denied there were so many deaths due to lack of oxygen or any other negligence.

Indore: Lok Sabha Speaker Sumitra Mahajan, Union minister M Venkaiah Naidu and Madhya Pradesh Chief Minister Shivraj Singh Chouhan had a providential escape on Monday, 5 June 2017 when a huge shamiana (tent) erected for a special function came crashing down as clouds gathered and soon winds at high speed and heavy rain ploughed through that area and the makeshift tent shelter came crashing down

The power supply was snapped and there was huge panic and those among the audience ran for their life. For some time, it was a stampde like situation. Besides the uprooted shamiana, what further added to the chaos was immense water-logging.

While the dignitaries were safe at least two dozen people were injured and some of them who were critical with head and chest injuries had been admitted in ICU.

Even as the other VIPs were rushed away, the Chief Minister chose to stay back and was seen supervising the relief operations.

May 5, 2016 Ujjain

Exactly a year ago – on May 5 – many persons were killed and over hundred were injured when makeshift tents erected for “Parva snan” during the Simhastha festival at Ujjain came crashing down when winds coupled with rain and hail swept through this area bring death and destruction.

These two incidents should wake up the authorities and it should be mandatory for them to check the meteorological report in advance before taking the reckless step of organising such functions in gross disregard of human safety under giant shamianas, which are becoming bigger and bigger under a robust democracy. Particularly, it should be mandatory for organisers to provide the Met report, 24 hours in advance, before going ahead with any function under a shamiana. Even at the last moment, the concerned authorities should have the powers to call off an event on grounds of adverse weather condition.

As per Government of India service tax rules under Finance Act 1997, “Pandal or shamiana” means a place specially prepared or arranged for organizing an official, social or business function.

New Delhi: Indore has emerged as the India’s Cleanest City in the Swachh Survekshan-2017 conducted in 434 cities and towns, the results of which were announced here today by Minister of Urban Development M.Venakaiah Naidu.

Bhopal, Visakhapatnam, Surat, Mysuru, Tiruchirapally, New Delhi Municipal Council, Navi Mumbai, Vadodara and Chandigarh are among the Top 10 clean cities in that order.

10 towns that came at the bottom of the 434 surveyed are; Gonda (UP) ranked 434 followed by Bhusawal (Maharashtra), Bagaha (Bihar)- 433, Hardoi (UP)-432, Katihar (Bihar)-431, Bahraich (UP)-429, Muktsar (Punjab)-427, Muktsar (Punjab)-426 and Khurja (UP)-425.

Announcing the Survey Results, Naidu described Madhya Pradesh, Gujarat, Jharkhand and Chattisgarh followed by Andhra Pradesh and Telangana as the Movers and Shakers for having significantly improved their rankings from that of the Survey conducted in 2014 before the launch of Swachh Bharat Mission in October, 2014. Swachh Survekshan conducted in 2016 covered 73 cities with over million population each besides capital cities.

The Minister further informed that in Swachh Surekshan-2017,  all the cities surveyed in Madhya Pradesh and Jharkhand have substantially improved their rankings over that of 2016 and 2014. Gujarat did so in respect of all cities excepting Rajkot and similar being the case in respect of Chattisgarh except Bilaspur. In Telangana, only two cities have dropped in rankings this year while it happened in respect of four cities in Andhra Pradesh.

Naidu stated that a total of 14 States were represented in the Top 50 clean cities with Gujarat accounting for 12, followed Madhya Pradesh-11, Andhra Pradesh-8 and one each from Chandigarh, Chattisgarh, Delhi, Jharkhand, Karnataka, Sikkim and Uttar Pradesh.

25 towns from Uttar Pradesh are ranked among the bottom 50 cities with followed by Rajasthan and Punjab with five each, two in Maharashtra and one each from Haryana, Karnataka and Lashadweep.

Varanasi has however, improved its rank from 418 in 2014 to 32 this year to become the Fastest Big City Mover in the North Zone.

The Minister said that UP, Bihar, Rajasthan, Punjab and Kerala need to substantially step up efforts to improve sanitation standards in urban areas.

Faridabad in Haryana has improved its rank from 379 in 2014 to 88 this year and has been awarded for being the ‘Fastest Mover’ among cities with a population of above one million each.

Venkaiah Naidu stressed that this year’s survey results are “Citizens’ Verdict” on cleanliness in urban areas of the country with 37 lakh citizens’ enthusiastically providing feedback on cleanliness in 434 cities and towns accounting for about 60% of the total urban population in the country. He stated that such survey will be commissioned in all the 4,041 statutory towns and cities.

Naidu further referred to India improving its position by 12 places in the global Travel and Tourism Competitive Index and feedback from media persons as further confirmation of improving sanitation in urban areas.

Referring to Mysuru in Karnataka which topped the ranks in 2016 and 2014 and ranked five in this year’s survey, Naidu asserted that in no way it meant that cleanliness has declined in the city or the city government scaled down its efforts. He explained that Mysuru scored over 87% out of the total score of 2,000 in both 2017 and 2016 indicating that sanitation level has not come down this year while other cities have scored over Mysuru. “This spirit of competition is sought to be promoted through such surveys to help cities know where they stand in absolute terms and in relation to other cities as well” said the Minister.

38 cities were awarded including the Top five clean cities at the national level, cleanest cities and fastest movers  in different zones in 5-10 lakh and 2-5 lakh population categories.

Swachh Survekshan-2017 aimed at capturing the outcomes on ground of the ongoing efforts to make urban areas Open Defecation Free and to improve door-to-door collection, processing and disposal of Municipal Solid Waste. Of the total score of 2,000, 900 marks were assigned for performance in respect of ODF and solid waste management, 600 marks for Citizen Feedbak and 500 marks for Independent Observation.

Quality Council of India that conducted the survey during January-February this year deployed 421 assessors for on the site inspection of cleanliness in 434 cities and towns and another 55 for real time monitoring of progress of survey and field inspections. Field inspectors used geo-tagged devices for collecting evidence in real time of their inspection at 17,500 locations.

Indore: Union Minister for Urban Development Venkaiyah Naidu today said that continuous power supply and good roads and adequate availability drinking water has made Madhya Pradesh a very special State.

He said that Madhya Pradesh was earlier called a BIMARU State but this is now a thing of the past. Madhya Pradesh has become a leading state in the last one decade. Madhya Pradesh is also leading in the agriculture sector and has become an ideal destination for investment.

The Minister said that development has taken place in Madhya Pradesh due to better leadership and public-centric policies. The growth rate of the state is above 10 percent. Programmes like Make in India, Digital India, Clean India, Start Up India, and Smart City have been launched in India to face challenges of 21st century. The world bank has termed Indian economy as the most open economy. International Monetary Fund has termed Indian economy for the year 2016-17 as the fastest developing economy in the world. GST has been passed in 23 states. She said that foreign direct investment worth ₹ 55.5 million dollars has been received in India after the formation of the NDA Government at the Centre led by Prime Minister Narendra Modi

Expressing gratitude towards all the investors, Chief Minister Shivraj Singh Chouhan said that Investors are honourable partners in the development of Madhya Pradesh. He said this summit has become strong platform for business dialogues with the government. Thirty online proposals have been received during the summit and land will be allotted to them shortly. Chouhan informed that 2630 investors have given proposals worth ₹. 56284.7 million during the Indore summit.

Bhopal: Union Minister for Urban Development Venkaiah Naidu today said that Madhya Pradesh has done tremendous work in infrastructure development and gave the assurance that the Centre would extend full cooperation for the execution of the Bhopal and Indore metro train projects.

Naidu was addressing a workshop on urban development issues at the Academy of Administration in the state capital.

Drawng attention to the Prime Minister’s “Reform, Perform and Transform” mantra, Naidu laid special emphasis on designing urban development schemes keeping in view the needs of the next ten years. The Centre is providing requisite funds, he said and went on to inform the gathering that the States are getting 45 percent of tax revenue under the new policy. He said that urban development is possible only with the participation of people. People must appreciate the concept of the smart city. He said that competition between cities is in the largest interest of the State. The clean India movement should turn into a public movement, he said and appreciated the good work done in implementing the waste-to-energy projects in Jabalpur and Indore.

Speaking on the occasion, Madhya Pradesh Chief Minister Shivraj Singh Chouhan said that the state will take up the “Nagaroday” campaign from 25 December to 25 January to enlist greater public participation. He also announced that uUrban developmental projects will be completed in a mission mode.

The chief minister said that the urban Madhya Pradesh would become open defecation free by December 2017. Each family will be given plots in order to realize Prime Minister’s vision of housing for all. In order to transform the cities, Rs. 205000 million will be spent on smart cities and Rs. 85000 million under AMRUT scheme.

Similarly, Rs. 14000 million would be spent on urban drinking water schemes in the first phase and Rs.5000 million in the second phase. In the first phase of the Chief Minister’s Urban Infrastructure Development scheme, Rs. 5000 million has been spent and in the second phase Rs. 18000 million more would be spent. Madhya Pradesh would become a pioneering state in respect of urban development.

Speaking of visible change in the overall scenario over the last one decade, the Chief Minister said that Madhya Pradesh has become the first choice of investors. He said that the State Government treats investors as partners in the process of development. Minister for Industries Rajendra Shukla and senior officials were present.

Welcoming investors to Madhya Pradesh, Chouhan assured them that there would be no hurdles in their way. The State Government intends to give the young manpower opportunities of growth through industrial development. For achieving this goal, they are being equipped with skills and are also being oriented for entrepreneurship.

Chouhan invited the prospective investors to the Global Investors’ Summit to be held at Indore later in October this year.

The Chief Minister held discussions about investment in the state in sectors like education, Information Technology, Public Service, construction engineering, biotechnology.

Arceus Infotech Private Limited has shown interest in setting up a development center in Bhopal. The US Technology International Private Limited also expressed willingness to invest Rs. 400 crore for setting up IT Campus at Bhopal. The US major in IT and food sector – LT Foods and its vendors are also willing to invest.

International Research Laboratories Pvt. Ltd. is willing to expand its operation in the State to address cataract blindness as a key player in the global blindness eradication campaign ‘Help Me See’.

RMC, USA, which deals in building materials for the construction of residential and commercial supplies also showed interest.

The Chairman of US India Business Council Mukesh Aghi met the Chief Minister and discussed the future strategies to enhance bilateral trade between US and India.

The Council was formed for trade collaboration between The Governments of the US and India. The India-US business ties is a leading business consulting organization. The USIBC is the largest bilateral trade organization, which includes representatives of the American and Indian companies.

Union Cabinet clears leasing out of land for perishable cargo hub at Indore airport

Cargo hubNew Delhi: The Union Cabinet, chaired by Prime Minister Narendra Modi, has given its approval for leasing out Airports Authority of India (AAI) land measuring 1500 sqm. to M.P. Warehousing Logistics Corporation (MPWLC) for establishing the Centre for Perishable Cargo (CPC) at Indore airport in Madhta Pradesh considering the resolution made by AAI Board.

This Centre will be a state of art facility exit point for perishables from the State. It will provide a world class facility under one roof to cater to all requirements of the traders and maintain the quality of produce. This facility is to be created by MPWLC under PPP mode.

The creation of Centre for Perishable Cargo is expected to cater to the employment needs of the local population and has significant employment potential. A total number of 113 persons will be required to manage the CPC.


The State Government of Madhya Pradesh proposes to set up  the CPC at Devi Ahilya Bai Airport in Indore. The move comes in the backdrop of huge demand of export of pharmaceuticals, poultry products and horticulture products ftom the western Madhya Pradesh (Malwa region).

The leasing out of the land will enable State Government of Madhya Pradesh to promote its agriculture and Horticulture sector by establishment of Centre for Perishable Cargo at Indore airport.

Supreme Court sets aside HC order in a land dispute linked with a 1948 Covenant between Maharaja Holkar of Indore and the State Government

Supreme Court of India has passed a landmark judgement turning down a decree of the Madhya Pradesh High Court that had earlier set aside the order of the Trial court in favour of Madhya Pradesh Government in a dispute arising out of a 1948 Covenant between the erstwhile Maharaja Holkar of Indore and the State Government over the ownership right on certain pieces of land by the reason of Article 363 of the Constitution of India.

The apex court order comes in response to Civil appeal (NOS. 557-558 OF 2012) by State of Madhya Pradesh against Maharani Ushadevi regarding the judgement and decree of judgment and decree of 13 August 2010 and 11 February 2011 of the High Court of Madhya Pradesh, Bench at Indore in First Appeal No. 421 of 2001 and in Review Petition No. 396 of 2010 respectively by which the High Court while setting aside the judgment and decree of the learned Trial Court passed in favour of the State, decreed the Suit for declaration of title in favour of Maharani Ushadevi and also dismissed the review petition preferred by the State.

Dealing with the applicability of Section 158(2) of the Madhya Pradesh Land Revenue Code, 1959 that came into force with retrospective effect from 2 October 1959 and reads as follows:

A Ruler of an Indian State forming part of the State of Madhya Pradesh who at the time of coming into force of this Code, was holding land or was entitled to hold land as such Ruler by virtue of the Covenant or agreement entered into by him before the commencement of the Constitution, shall, as from the date of coming into force of this Code, be a Bhumiswami of such land under the Code and shall be subject to all the rights and liabilities conferred and imposed upon a Bhumiswami by or under this Code.

As per Section 158(2) in order to confer the rights of Bhumiswami a Ruler should be holding land or he should have been entitled to hold land as such Ruler by virtue of a Covenant or agreement entered into by him.

A two judge bench of the apex court, comprising Justice Ranjan Gogoi and Justice N.V. Ramana has categorically observed that the respondent 9Ushadevi) cannot seek the status of Bhumiswami independent of the Covenant because the rights under Section 158(2) arise out of the Covenant itself. The source to hold the land arises by virtue of a Covenant. When the right claimed by way of Covenant is disputed, the relief of settling these disputes is barred under Article 363 of the Constitution. Hence, the court has said in its order: “one cannot claim to be “Bhumiswami” under Section 158(2) of the Madhya Pradesh Land Revenue Code, independent of the Covenant. On this basis the Court has settled the issue in favour of the appelant, that is the State of madhya Pradesh and against Ushadevi, the respondent. The Supreme court has set aside the judgments of the High Court in this case and ordered that the Suit filed by the Ushadevi for declaration and injunction is barred under Article 363 of the Constitution of India and the plaintiff is not entitled for any relief under Section 158(2) of the Madhya Pradesh Land Revenue Code claiming the rights of Bhumiswami.

Supreme Court has made it clear in its order that “Covenant was an act of State and any dispute arising out of its terms cannot form the subject matter in any Court including the Supreme Court, and there cannot be any implied recognition of the property as private property at any later stages when an opportunity had already been granted to raise issue in terms of clause 3 of Article 12 before defined period; above all, the properties do not find place in the Covenant.” It has been pointed out by the Supreme Court in its order that the plaintiff/respondent is trying to interpret the Covenant that all properties which are in the custody of the Household Department are the personal properties of the Ruler. We feel that such interpretation and implied recognition is impermissible as held by this Court in Draupadi Devi case.

The Supreme Cour has also remarked that the Court (High Court) “erred in entertaining the Suit without properly taking into consideration the judgments and the proposition of law laid down by this Court in catena of cases”. Hence the Court was of the view that the relief in the Suit falls within the ambit of Article 363 of the Constitution of India and the Suit is not maintainable. Accordingly first issue is answered in favour of the State (Madhya Pradesh) and against the respondent/plaintiff (Ushadevi).

In the Karan Singh (Dr.) vs. State of J&K, (2004) SCC 698, while examining the applicability of Article 363 of the Constitution to the disputes arising out of a treaty, Covenant etc., the Supreme Court had observed that all Courts including the Supreme Court is barred to determine any right arising out of a Covenant . The correspondence exchanged between the Ruler and the Government would amount to agreement within the meaning of Article 363.

Aslo in Madhav Rao Jivaji Rao Scindia (supra), the apex court, while interpreting Article 363 of the Constitution, observed that a dispute relating to the enforcement, interpretation or breach of any treaty etc., is barred from the Courts’ jurisdiction. The Supreme court has explained in its present order that the bar comes into play only when the dispute is arising out of the provisions of a treaty, Covenant etc., as in the present case adding that it had held that Article 363 has two parts. The first part relates to disputes arising out of Agreements and Covenants. The jurisdiction of the Supreme Court and other Courts is clearly barred in respect of disputes falling within that part. Then comes the second part of Article 363 which refers to disputes in respect of any right accruing under or any liability or obligation arising out of any of the provisions of the Constitution relating to any agreement and Covenant and it was specifically mentioned that right as mentioned in Article 363 signifies property.

The Supreme Court order in the present case places on record the finding of the Trial Court that the lands were retransferred to the Holkar State in the year 1951, and re-transferring is without any authority and it is bad. The Trial Court held that though it is the specific case of the plaintiff that they are paying Tauzi, there is no evidence to show that they have paid Tauzi prior to 1951 and the correspondence of the plaintiff and her father shows that the Suit scheduled properties were not included in item no 14 of the list of properties and further held that Suit scheduled properties were allotted to the Forest Department. On the issue of transfer of land to Forest Department, apex court brings on record that it is settled law that parties are governed by their pleadings and the burden lies on the person who pleads to prove and further plaintiff has to succeed basing on the strengths of his case and cannot depend upon the weakness of the defendant’s case. The State having alleged several things, has failed to mark any document to show that the properties were transferred to the Forest Department and the retransfer in the year 1951 was without any authority of law. “Though the State has filed certain documents before us, but as they are not part of the evidence, we are not inclined to look at those documents”, the apex court has said.

The Counsel for the State contended that the first and foremost question that arises is whether the High Court had jurisdiction in a dispute arising out of the Covenant 16 June 1948 between the erstwhile Maharaja Holkar and the Government by the reason of Article 363 of the Constitution of India. The counsel stated that the instant Suit fell within the two limbs of the Article 363 as the present dispute clearly arose out of the terms of the Covenant. The Supreme Court has said in its order that the Trial Court, therefore, rightly dismissed the Suit of the respondent, but the High Court committed a gross error by ignoring the constitutional provisions and settled principles of law. The claim for declaration of the properties in question to be the private properties of late Maharaja in terms of Item No. 14 of the list of properties, was a dispute arising out of the terms of the Covenant, and it has been clearly mentioned in Article 363 of the
Constitution that jurisdiction of the Courts to adjudicate such claims was barred.

The facts leading to these appeals, in brief, are that Maharani Ushadevi who was the daughter and reportedly sole heir of Maharaja Yashwanth Rao Holkar, the erstwhile Ruler of Holkar State filed the Suit in question on 7 September 1964 seeking the relief of declaration of title and permanent injunction in respect of certain properties (Beeds known as Bijasan, Ashapura, Bercha, Mohna and Gajihata) and alternatively sought declaration that the plaintiff is the Government lessee or a Bhumiswami of the Suit schedule properties.

Her case was that these birs were initially under the control of the Household Department of the Holkar State. Sometime during the existence of the Holkar State, the work of cutting and collecting the grass of these four beeds was made over to the Military Grass Farm of Indore with a direction that the quantity of grass required for the purpose of household has to be supplied by them.During the lifetime of Maharaja Yashwant Rao Holkar, he was depositing Tauzi assessment/revenue charges with the treasury of Holkar State. On 31-08-1945, these birs were transferred to the Army Department of the Holkar State, for harvesting grass, for a period of one year on experimental basis. Again on 22 January 1951, these beeds were transferred to the Maharaja and from that date, these beeds were in continuous possession and enjoyment of the plaintiff’s family till the filing of the Suit. In the year 1948, Holkar State along with the other princely States was merged with the Dominion of India as per the Covenant of 16 June 1948, which was later on re-organised as a part of the present State of Madhya Pradesh. As per Article XII of the Covenant entered between Maharaja Yashwant Rao Holkar and Government of India, Ministry of States, by communication dated 7 May 1949, the land in question that was being managed by the Household Department of teh Holkar State became the exclusive and individual property of the father of Maharani Ushadeve. As the property belonged to the Maharaja, even the Government demanded revenue for the said land which was duly deposited by the plaintiff’s father as well as the plaintiff. It is further case of the plaintiff that the State Government appeared to have passed some orders on 2 May 1964, basing on which, the Collector, Indore had issued a notice on 16 May 1964 requiring the plaintiff to handover the possession of the land in question on the ground that the State Government has declared the Suit schedule property as the property of the State. According to the plaintiff, she held these lands either as an owner or as a Government lessee, and Government had no jurisdiction to pass such an order. Then the plaintiff moved the Sub-Divisional Magistrate under Section 57 of the Madhya Bharat Land Revenue Code to adjudicate the dispute, but the same was rejected on the ground that they had no jurisdiction. Hence, the plaintiff was constrained to file the Suit seeking the relief of declaration and injunction.

The appellant – State – contested the Suit by filing written statement disputing the ownership of plaintiff over the Suit land. According to the defendant (State), Maharaja Yashwant Rao Holkar was never the owner of the Suit scheduled property. Hence, the question of plaintiff succeeding to the property did not arise. The beeds were the property of the Forest Department of the Holkar State. On 21 August 1926, the Cabinet of Holkar State transferred Bijasan Beed to the Household Department, and later the remaining beeds were also transferred on settlement of assessment. Later these beeds were transferred to the Forest Department in 1930. Again in 1943, they were re-transferred to the Household Department. It is the case of the defendant that in 1945, all birs were with the Army Department of the Holkar State, which was made responsible to supply grass to the Household Department. At the time of merger of Holkar State with Dominion of India, these Beeds were with the Army Department and hence could not be treated as private properties of the Maharaja as per Item No.14 of list of private properties and apart from all these grounds, it was urged by the State that the Suit was not maintainable in view of the bar under Article 363 of the Constitution of India. Basing on the above pleadings, the defendant sought dismissal of the Suit.

The Supreme Court order says: “It appears that in the year 1979, Section 158(2) was inserted in Madhya Pradesh Land Revenue Code, 1959. As per the said provision, the Ruler of an Indian State, forming part of State of Madhya Pradesh, who at the time of coming into force of the Act was holding land or was entitled to hold land by virtue of the Covenant shall, as from the date of coming into force of the Code, becomes a Bhumiswami of such land.”

Chief Minister Shivraj launches 5 MT Underground Copper Mine at Malajkhand

Bhopal: On Sunday, when Prime Minister Narendra Modi was launching the world’s biggest industrial fair – Hanover Messe 2015 –  jointly with German Chancellor Angela Merkel, the chief Minister of the Central Indian State of Madhya Pradesh Shivraj Sinbgh Chouhan was laying the foundation stone of the ambitious 5 MT capacity underground copper mine project at Malajkhand in Balaghat district.

On this occasion, Mr. Chouhan said that 25 percent of total royalty on minerals mined from an area will be spent on development of that area. The INR 2000 crore project will give employment to 5000 people – 50% of these would be employed directly.

The Chief Minister said that due to this project, the names of two places in Balaghat district – Malajkhand and Baihar – will be written in golden letters.

The MoU for the Malajkhand project was signed at the Indore Global Investors Summit and today, the project is being launched with the cooperation of the Central government, the chief minister said.

Union Minister for Mining and Steel Narendra Singh Tomar, who presided over the function said that Malajkhand copper project is among the biggest, not only in country but also in Asia. Its expansion could have been effected much earlier, but it got delayed due to lack of coordination between the Central and the state government. He said that as a result of sustained efforts of Chief Minister over the last 10 year period, possibilities of investment in Madhya Pradesh have increased. Investors have evinced keen interest. He said a processing plant in this area will also be considered once the 5 MT annual capacity is achieved by the underground copper mine.

After the Indore Global Investors’ Summit in October 2014, Madhya Pradesh Chief Minister has adopted the approach of direct dialogue with investors. When in Bhopal – the state capital – he holds one-to-one meetings with investors on the first Monday of each month. After the Indore Summit, Mr. Chouhan has held one-to-one meetings with 29 investors. During the period, 6 investors from America also met the Chief Minister and discussed their investment proposals.

Ruling BJP sweeps civic polls in MP, BJP Mayors in Bhopal, Indore, Jabalpur and Chhindwara

civic pollsBhopal, Feb. 4: BJP’s Alok Sharma was today declared elected as the new Mayor of Bhopal. he defeated his nearest rival Kailash Mishra of Congress by 76332 votes. While Mr. Sharma got 442412 his main rival secured 356080 votes.

In all there were 17 candidates, including one from the Bahujan samaj Party in the fray for Bhopal Mayor’s post.

BJP’s Malini Lakshman Singh Gour has won the mayor’s election in Indore by polling 620083 votes. She defeated her nearest rival Archana Jaiswal of Congress, who got 373487 votes.

The Jabalpur Mayor’s post has gone to BJP candidate Dr. Swati Sadanand Godbole. She got 298433 votes against her main rival Gitasharan Tiwari of Congress who received 212942 votes.

Making it a clean sweep in all the Municipal corporations where mayors’ elections were held, the BJP has also won the Chhindwara Mayor’s post. BJP’s kanta Yogesh Sadarang won this seat by polling 61730 votes against Kalpana Rajendra Suryavanshi of CVongress who got 52151 votes.

In the four municipalities (nagarpalika), where polling was held, the chairpersons post has gone to the BJP in Datia, Badoni; Damoh, Patera; and Rajgarh, Chapiheda. The Congress candidates have won the post of chairman in Hoshangabad, Bankhedi and Vidisha, Shamshabad.
