Noida Authority Chief Engineer accused of amassing illegal wealth: CBI files charge-sheet

New Delhi: The Central Bureau of Investigation (CBI) has filed a charge-sheet against a former Chief Engineer, Noida/Greater Noida Authority; his family members including wife, two daughters, son, daughter-in-law; a Chartered Accountant; three private firms (through their authorised representatives) and a Charitable Trust (through their trustees) in the Court of Special Judge, CBI Cases, Ghaziabad (Uttar Pradesh) in a Disproportionate Assets case.

Investigation has revealed that during the check period from 1 April 2004 to 4 August 2015, then Chief Engineer and his family members were found in possession of disproportionate assets worth Rs.23.15 crore which was disproportionate to the extent of 512.66% to his known sources of income.

Investigation also revealed that then Chief Engineer and his family allegedly incorporated 3 private limited companies, 3 proprietary firms and 1 charitable trust to convert the black money into white.
Income shown in these companies/firms were allegedly found to be managed through accommodation entries after providing equivalent amount of cash through batteries of CAs in various manners, like money routed showing as unsecured loan, share application money, selling of shares at premium.

It may be recalled that CBI had registered a case on 30 July 2015 nder section 109 of Indian Penal Code read with 13(2) read with 13(1)(e) of Prevention of Corruption Act 1988 against then Chief Engineer, NOIDA/ Greater NOIDA Authority (UP); his family members and his business associates in compliance of the orders passed on 16 July 2015 by the High Court of Allahabad, Lucknow Bench in Misc. Bench No. 12396 of 2014 on the allegations of acquiring huge assets which were disproportionate to his known sources of income.

Searches were conducted during August, 2015 at the premises of accused persons at 16 locations including at Noida, Agra and Lucknow. During the searches, it was found that the accused Chief Engineer was allegedly having 3 immovable properties; his wife was having 19 immovable properties and son 3 immovable properties. It was also revealed that jewelllery worth Rs. 1.04 crore was allegedly purchased during the check period by the family of then Chief Engineer.

New Delhi: The Special Judge, CBI Cases, Patiala House Courts, New Delhi has found guilty and sentenced Kailash Patil Aneja, former Director (ERU), Department of Telecommunication, Sanchar Bhawan, New Delhi (an officer of Indian Economic Service of 1981 batch) to undergo four years Rigorous Imprisonment with fine of Rs.25 lakh.

The convicted Indian Economic Service officer’s wife Anita Aneja will undergo three years Rigorous Imprisonment with fine of Rs. one lakh in the Disproportionate Assets case.

CBI had registered this case on 29 September 2005 against K.P. Aneja. He was then posted as Director (ERU), Department of Telecommunication, New Delhi. It was alleged that during the period from 1982 to 2005, the accused acquired assets in the form of shares, properties, and gold which were found to be disproportionate to the known sources of his income to the tune of 43% of his legal earnings (approximately Rs. 24.45 lakh). After investigation, a chargesheet was filed on 20 December 2011 against the accused and his wife. During the trial, 69 witnesses were examined and a large number of documents were relied upon by the Court.

Chennai: AIADMK leader J Jayalalitha was sworn-in as Chief Minister of Tamil Nadu for the fifth time today. (Original news updated)

Tamil Nadu governor K Rosaiah administered Jayalalitha the oath of office as chief minister

After her election as AIADMK legislature Party leader, Chief Minister O. Panneeselvam submitted his resignation and state Governor K. Rosaiah invited her to form the next Government on Friday.

Jayalaltha had to quit as Chief Minister after she was sentenced to four years in jail and fined Rs 100 crore by a Special Court in Bangalore in the disproportionate assets case.

The way was cleared for her resturn as Chief Minister after Justice C.R.Kumaraswamy of the Karnataka High Court acquitted her in the disproportionate assets case on 11 May.

  • In 1991, following the assassination of Rajiv Gandhi, her alliance with the Indian National Congress enabled the ADMK coalition victory.The ADMK alliance with the Congress won 225 out of the 234 seats contested and won all 40 constituencies in the Centre. she became the first woman and the youngest chief minister of Tamil Nadu and served a full term from 24 June 1991 to 12 May 1996.
  • The Jayalalitha-led AIADMK lost power in the 1996 elections, when it won 4 of the 168 seats that they contested. She was herself defeated by the DMK candidate in Bargur Constituency.
  • Jayalalitha was barred from contesting the 2001 election as she was found guilty of criminal offences, and alleged obtaining of property belonging to a state-operated agency called TANSI.
  • She appealed to the Supreme Court, on being sentenced to five years’ imprisonment and the matter was pending at the time of the elections. The AIADMK won a majority in that election and she was installed as Chief Minister as a non-elected member of the state assembly on 14 May 2001.
  • Her appointment was held legally void in September 2001. The Supreme Court ruled that she could not hold office as Chief Minister as she had been convicted by court. O. Panneerselvam, a minister in her party, was subsequently installed as the Chief Minister.
  • In March 2002, Jayalalitha again took over as Chief Minister after she was acquitted of charges by the Madras High Court. She contested and won a mid-term poll fromthe Andipatti constituency, after the sitting MLA holding that seat, resigned.
  • In April 2011 the 13-party AIADMK alliance won the 14th state assembly elections and Jayalalitha was sworn in as the chief minister of Tamil Nadu for the third time on 16 May 2011.
  • On 27 September 2014, Jayalalitha was sentenced to four years in jail and fined Rs 100 crore by the Special Court in Bangalore. She was convicted in an 18-year-old disproportionate assets case.
  • Her trusted lieutenant and diehard supporter O. Panneerselvam, a state minister, succeeded as the Chief Minister on 29 September 2014.
  • On 17 October 2014, Supreme Court granted two months bail and suspended her sentence in the Disproportionate Assets Case.
  • Justice C.R.Kumaraswamy of the Karnataka High Court acquitted Jayalalitha in the disproportionate assets case on 11th of May, 2015

Former Income Tax Commisioner and his wife convicted in Disproportionate Assets case

corruptionMumbai: The Special Judge for CBI cases in Mumbai (Maharashtra) has convicted Ashok Kumar Purwar, a former Commissioner of Income Tax (IRS Officer of 1971 Batch) and his wife Chhaya Purwar under section 13(2) read with 13(1)(e) of the Prevention of Corruption Act, 1988 and 109 of Indian Penal Code in a 14-year old disproportionate assets case.

Ashok Kumar Purwar has been sentenced to undergo three years simple imprisonment with fine of Rs. 100,000 and his wife Chhaya Purwar to undergo two years simple imprisonment with fine of Rs. 50,000.

CBI had registered a case against Purwar and his wife on December 3, 2001 on the allegations that the accused had amassed assets disproportionate to his known sources of income. They were also in possession of residential flats (partments) in Delhi, Ahmedabad, Indore & a plot in Agra, beside Kisan Vikas Patras to the tune of Rs 2.17 crore; certain branded watches valued to Rs. 5,00,000 and Shares and FDs worth Rs. 20,00,000.

Purwar had served at many places, including Mumbai and Ahmedabad, as Deputy Commissioner and Commissioner of Income Tax. He had amassed assets worth Rs. 1.90 crores during the period from 1989 to 2001 which were disproportionate to his known sources of income. After investigation, a chargesheet was filed against both the accused.

The Trial Court found both the accused guilty and convicted them. The Court also ordered the forfeiture of the Kisan Vikas Patras and the branded watches.
