Big jolt for AAP: EC rejects plea by 21 MLAs in the office of profit case

New Delhi: The Election Commission of India today (24 June 2017) rejected the plea by Aam Aadmi Party (AAP) and its 21 Delhi MLAs to drop the office of profit case against them.

In its order, as reported by a section of the media, EC has stated that the Commission was of the “considered opinion” that the AAP MLAs de facto (held) the office of parliamentary secretaries between March 13, 2015 and September 8, 2016.

Today’s order comes in connection with the petition of Prashant Patel, Advocate, seeking disqualification of Praveen Kumar, Member of the Delhi Legislative Assembly, and 20 other Members of the Delhi Legislative Assembly. The hearing in this matter had concluded in March this year and the EC had reserved the order.

The petitioner had first made a two pages complaint on 19 June, 2015 to the President in terms of section 15(3) of the Government of NCT of Delhi Act 1991 alleging that the 2l Members of the Delhi Legislative Assembly have become disqualified for continuing as Members of the Assembly as they were holding office of profit under the Government of Delhi.

On 28 December, 2015, the petitioner made a second complaint direct to the Commission.

Through their counsels, the applicants in this case – Bharatiya Janata Party and Indian National Congress, submitted before the EC that the present proceedings raised important questions of law and facts and their interest, being national parties, lay in assisting the Commission to come to right decision by producing all relevant case law and information.

Enquiry proceedings were initiated by the Election Commission on the basis of the reference received from the President of India under section 15(4) of the Government of the National Capital Territory of Delhi Act, 1991 seeking the opinion of the Commission on the question of alleged disqualification of 21 sitting members of the Delhi Legislative Assembly

Arguing their case, the 21 AAP MLAs/respondents had contended that the case be dropped against them as the Delhi High Court had already given a ruling in this matter. The petitioner, Prashant Patel had opposed this argument on the ground that the respondents were holding office of profit till their appointments were set aside by the High Court.

After the Aam Aadmi Party MLAs had been appointed as parliamentary secretaries in March 2015, the Delhi Members of Legislative Assembly (Removal of Disqualification) Act, 1997 had been amended with retrospective effect to exclude the post of parliamentary secretary from the definition of office of profit.

New Delhi: The Bharatiya Janta Party (BJP) has defeated the Aam Aadmi Party and routed the Congress in the Delhi Municipal elections.

The BJP addressed the anti-incumbancy factor by giving tickets to new faces instead of fielding the sitting corporators and this strategy adopted earlier in Gujarat by Prime Minister Narendra Modi when he was chief minister has once more paid dividends in the form of a landslide victory in Delhi. The BJP has improved its performance over the last election by increasing its seats tally from 138 to 184.

The Aam Aadmi Party could win only 46 seats, whereas the Congress could win only 30 and others 10.

As results started coming in this and the writing on the wall was clear that the AAP had been routed, Delhi’s Deputy Chief Minister and AAP leader Manish Sisodia, while talking to media-persons, used the electronic voting machines as an excuse for his party’s electoral debacle.

Delhi CM Arvind Kejriwal addresses huge crowd in Bhopal

arvind-kejrivalBhopal: Delhi Chief Minister and National Convener of Aam Aadmi Party (AAP) Arvind Kejriwal today started the campaign, two years ahead of Madhya Pradesh Assembly election to oust the Bharatiya Janata Party from power in this Central Indian State.

Addressing a huge party rally at Chhola Dussehra Maidan here described the Madhya Pradesh government headed by Shivraj Singh Chouhan as corrupt and and also accused Prime Minister Narendra Modi of benefitting those in the BJP by demonetisation of scrapping of old notes.

Kejriwal said that that both the Congress and BJP take turns to loot the people. Both the parties are hand in glove he added.

The AAP chief said that the Modi Government does not waive the farmers’ loans but writes of the loans of the capitalists and the rich.

Kejriwal said that people are angry and they are coming in huge numbers to hear about corruption.

AAP files a 2000-page reply to Jaitley’s defamation case today

AAP-SYMBOLNew Delhi : Aam Aadmi Party (AAP), which was faced with defamation case against Kejriwal and Co. filed by none other than the finance Minister himself, Arun Jaitley, are finally ready to reply. Having pondered over the issue, and amidst series of retaliations in media and social networking sites, the Kejriwal-led AAP has inked a voluminous reply (read book), a 2000-page reply, and have decided to file it in the Delhi High Court today as a reply to the civil defamation case filed by Union Finance Minister Arun Jaitley.

Jaitley had filed a criminal defamation complaint against Delhi Chief Minister Arvind Kejriwal and five other AAP leaders On December 21, 2015 for allegedly bringing down his image and maligning his name in the Delhi and District Cricket Board (DDCA) controversy. The case had got presented before a Delhi court which had taken cognizance on his plea. FinMin had also made his opinion loud and clear in Lok Sabha during winter sessions, where he had said — All these allegations are baseless and devoid of truth. For a total sum Rs. 114 crore, we made a stadium with a capacity of taking 42,000 people. Contrary to that, the Congress built the Jawaharlal Nehru Stadium spending Rs. 900 crores. No one raised doubts on that expenditure.

AAP has always tried to bring itself to the spotlight by waving out such papers, and has been famous for bringing up accumulated bundles of sheets on leaders of the opposition camps, in the likes of innumerable sheets on Shiela Dixit’s working practices, an election gimmick, the sheets — which are now lying somewhere, covered in dust since eternity (if the sheets really existed, that is). And the present paper roll is a 2000 sheeter reply on FinMin’s defamation plea, which the AAP is scheduled to lay on the table of Delhi High Court this Tuesday.

AAP-led Delhi government had set up a probe committee all by itself on the DDCA irregularities. However, the Ministry of Home Affairs (MHA) had declared that the probe committee formed by the Delhi Government to look into the affairs of the DDCA was `unconditional and illegal`.
