Ex-BJP MLA convicted in Unnao rape case
New Delhi: The Court of Delhi district Judge Dharmesh Sharma on Monday, 6 December 2019 said that the testimony of the victim was “truthful and unblemished” and convicted expelled BJP MLA Kuldeep Singh Sengar for raping a woman in Unnao in 2017.
The Court pulled up the CBI over the delay in filing the charge sheet in the rape case and said it also prolonged trial against the accused.
The court observed that a number of criminal cases were filed against the victim’s family after she wrote to the UP Chief Minister Yogi Adityanath and “imprints of Sengar” were visible in them.
Bringing in focus the POCSO that has been brought in force to impart speedy justice in cases where children are the victims of sexual assault, the court said that the law was firm in its place but its implementation was ineffective as a result of which justice was delayed.
The Court has also censured the CBI by pointing out that the principal investigating agency of the country was not following the manual relating to investigation and prosecution.
The victim was kidnapped and raped by Sengar in 2017 when she was a minor.
Earlier on August 9, the court had framed charges against Sengar and the co-accused Shashi Singh under Sections 120 b (criminal conspiracy), 363 (kidnapping), 366 (kidnapping or inducing a woman to compel for marriage), 376 (rape) of IPC and other relevant sections of the Protection of Children from Sexual Offences (POCSO) Act.
The Court has acquitted co-accused Singh of all charges.
The court will hear arguments on quantum on sentence on Wednesday, 18 December.
