New Delhi: The Special Judge for CBI cases, Chennai has convicted A. Ashokan former Deputy Commissioner of Central Excise in a disproportionate assets case and sentenced him to undergo 3 years rigorous imprisonment with fine of Rs. 50,000. The Court has also ordered for confiscation of disproportionate assets of Rs. 12,72,961.
CBI had registered and investigated the case against A. Ashokan on the allegations that during the check period September 1, 1989 to January 19,1998, while working as public servant in various capacities, he had acquired assets to the tune of Rs.21,40,140 in his name and in the name of his wife which was disproportionate to the extent of 87.74% against his known sources of income and expenditure incurred by him.
On completion of investigation, CBI filed a chargesheet against A. Ashokan and his wife under sections 120 B of IPC read with 13(2) read with 13(1)(e) of Prevention of Corruption Act, 1988. The Trial Court found A. Ashokan guilty and acquitted his wife from the case.
In another case, the Special Judge, CBI Cases, Jaipur has convicted Shrawan Kumar Swami then Head Cashier, State Bank of Bikaner & Jaipur, Srimadhopur Branch, District Sikar (Rajasthan) and sentenced him to undergo three year rigorous imprisonment with fine of Rs. 7000.
A case was registered on January 6,.2010 under Section 409 of IPC and Section 13(2) read with 13(1) (c) of Prevention of Corruption Act. 1988 against Shrawan Kumar on the allegation that he unauthorisedly took out 1099 pieces of Rs. 500/- denomination currency notes (valued Rs. 5,49,500) from 220 packets of Rs. 500 denomination currency notes from Bin No. 31 of the currency chest. He took out these currency notes from the packets while preparing the packets and from the packets prepared by the other Cahiers before depositing the same in the chest and thereby misappropriated the cash.
After completion of the investigation, a charge sheet was filed against Shrawan Kumar on June 29,2010 in the court of Special Judge, CBI Cases, Jaipur. The Court framed the charges against the accused on February 13, 2014 and convicted him.
